The Duma simplifies proceedings on economic disputes

The deputies adopted amendments to the Arbitration Procedure Code, which were developed by the Supreme Court in 2022. They will affect ordered and simplified proceedings, as well as procedural deadlines.The number of citizens’ claims, which can be considered in simplified proceedings, increased from 500,000 to 1 million rubles. The changes also affected sole proprietors – from 400,000 to 800,000 rubles, and companies – from 800,000 to 1.6 million rubles. Also, a new article 291.16 will appear in the APС, which defines the procedure for cassation proceedings in cases of an ordered or simplified procedure. By default, they will be considered without calling the parties. If the nature and complexity of the dispute or the arguments of the complaint and objections require this, the court may summon the participants in the case to a meeting.

The period for which the meeting can be postponed in case of illness of the judge is changing. Previously, it was 10 days. Now the deadline is 1 month. Regarding the appeal, its consideration will take place within three months, and six months will be allocated for consideration of the appeal instead of three months. Also, now only the foreigner retains the right to change the contractual jurisdiction, which allows, by agreement of the parties, to change the territorial jurisdiction of the case at their discretion.In addition, the amendments clarify the procedure for considering a complaint against a refusal to secure a claim, notifying defendants in intellectual disputes, and a list of appendices to the claim.
